Terms of Service

Welcome to Motivia. These Terms of Service ("Terms") govern your use of our application and constitute a legally binding agreement between you and Motivia.

By accessing or using our application, you agree to be bound by these Terms. If you do not accept these terms, please do not use our application.

Service Description

Motivia is an application that allows you to create, manage, and customize cover letters using your professional information and artificial intelligence technologies.

Our service includes:

  • CV Management: Upload, store, download, and delete your CV directly from the application
  • AI-Powered Generation: Create personalized cover letters using leading AI models (Claude, GPT-4, Gemini, Mistral, xAI)
  • Profile Extraction: Automatically extract your professional profile from your CV
  • Multi-format Export: Download your cover letters in various formats

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time, including the availability of any feature, database, or content.

User Account

To use certain features of our application, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your login information
  • All activities that occur under your account
  • Providing accurate, current, and complete information

We reserve the right to disable any user account at our sole discretion, particularly if we believe you have violated these Terms.

Subscription Plans and Credits

Motivia offers different subscription tiers:

  • Free Plan: Limited cover letters with basic AI models
  • Pro Plan: Extended monthly allowance with all AI models, browser extension, and application scoring
  • Premium Plan: High-volume generation with priority support

You may also use your own API keys from AI providers (OpenAI, Anthropic, Google, Mistral, xAI), in which case you pay those providers directly according to their pricing.

Intellectual Property

Motivia and its original content, features, and functionality are and will remain the exclusive property of Motivia and its licensors.

Regarding the content you create through our application:

  • Your Rights: You retain all rights to the cover letters you create
  • License to Us: You grant us a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, and distribute this content solely for the purpose of providing our services

Use of AI Services

Our application uses third-party artificial intelligence services to generate content, including but not limited to:

  • Anthropic (Claude models)
  • OpenAI (GPT models)
  • Google (Gemini models)
  • Mistral AI (Mistral models)
  • xAI (Grok models)

By using these features:

  • You agree that your data will be processed by these third-party services in accordance with their own terms of service and privacy policies
  • You acknowledge that AI-generated content may require review and customization
  • You are responsible for verifying the accuracy and relevance of the generated content before use
  • AI-generated cover letters should be reviewed for factual accuracy and appropriateness

If you use your own API keys for these services, you are responsible for their security and use in accordance with those providers' terms.

Acceptable Use

You agree not to:

  • Use the service for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of the service
  • Generate content that is fraudulent, misleading, or harmful
  • Misrepresent your qualifications in generated cover letters
  • Resell or redistribute the service without authorization

Limitation of Liability

To the fullest extent permitted by applicable law, Motivia shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether foreseeable or not.

Our total liability for any claim arising from or related to these Terms shall not exceed the amount you have paid to use our service in the twelve months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Motivia, its officers, directors, employees, and agents from any claim, damage, obligation, loss, liability, cost or debt, and expense arising from:

  • Your use of and access to the application
  • Your breach of these Terms
  • Your violation of any third-party right, including without limitation any copyright, property, or privacy right
  • Any content you submit or generate through the service

Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice before the new terms take effect.

By continuing to access or use our application after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the application.

Termination

We may terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive.

Applicable Law

These Terms are governed by and construed in accordance with French law, without regard to conflict of law principles. Any dispute relating to these Terms will be subject to the exclusive jurisdiction of French courts.
